Terms of Service

Effective date: April 13, 2026

These Terms of Service ("Terms") govern your use of the Harvest Tales iOS app and related services, operated by Greg Gentschev. By creating an account or using Harvest Tales, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 21 years of age to use Harvest Tales, consistent with the legal drinking age in the United States. By creating an account, you confirm that you are 21 or older.

2. Description of Service

Harvest Tales is a wine discovery app that lets you:

• Scan QR codes at wineries and wine shops to view wine writeups
• Save wine writeups to a personal collection on your device
• Connect to wine shops to view your purchase history, synced from the shop's Square point-of-sale system
• Add personal notes to wines in your collection

3. Account Registration

To access features beyond QR scanning and saving writeups, you must create an account. You agree to:

• Provide accurate and complete information (name, phone number)
• Maintain the security of your password
• Notify us promptly if you suspect unauthorized access to your account
• Maintain only one account per phone number

4. Wine Shop Connections

When you connect to a wine shop in the app, you authorize Harvest Tales to:

• Search the shop's Square customer records using your phone number to find your customer profile
• Retrieve your purchase history from that shop (order dates, items, quantities, and totals)

You understand that:

• Purchase data comes from the shop's Square system; Harvest Tales is not responsible for the accuracy of this data
• You can disconnect from any shop at any time, which permanently deletes all purchase data from that shop on our servers
• Shop availability depends on the merchant's participation; we do not guarantee any shop's continued availability in the app

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose, including violations of alcohol-related laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or other users' access
• Scrape, crawl, or use automated means to access the service in bulk
• Impersonate another person or misrepresent your identity

6. QR Codes and Wine Writeups

Wine writeups and tasting notes displayed in the app are informational content. We make no warranty regarding the accuracy, completeness, or suitability of wine descriptions, tasting notes, or recommendations. Saved writeups are stored locally on your device.

7. Intellectual Property

• The Harvest Tales app, its design, and its original content are owned by Greg Gentschev
• Wine writeup content may be owned by the respective producers or merchants who created it
• You retain ownership of any personal notes you create within the app

8. Account Termination

• You may delete your account at any time using the in-app Delete Account feature or by contacting us at gentschev@gmail.com
• We may suspend or terminate accounts that violate these Terms
• Upon account deletion, all of your data is permanently removed from our servers as described in our Privacy Policy

9. Disclaimers

Harvest Tales is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

Harvest Tales is not responsible for decisions you make based on wine information displayed in the app, nor for issues arising from Square integration, merchant participation, or the accuracy of data from third-party systems.

10. Limitation of Liability

To the maximum extent permitted by law, Greg Gentschev's total liability to you for any claims arising from your use of Harvest Tales is limited to the amount you have paid for the service (currently $0, as the app is free). In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of Harvest Tales shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved in the courts of appropriate jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the effective date at the top of this page. Your continued use of Harvest Tales after changes are posted constitutes your acceptance of the updated Terms.
